8.2.5 employment practice equivalent rights
 
Chonnam National University has established a Safety and Health Assurance Manual for construction (subcontracting) workers to fulfill the obligation to secure safety and health, thereby preventing serious accidents in advance and creating a work environment free of disasters. The university is committed to protecting the lives and bodies of educational workers from various harmful and dangerous factors, doing its utmost to create a safe educational environment where all university members, including faculty and outsourced workers, can feel secure.
 
In addition, temporary contract guidelines were implemented to mitigate the domestic and livelihood difficulties caused by COVID-19. These include the prompt payment of advances and subcontract fees to support the execution of public purchases and assistance to procurement companies.

Scope of Application:
The subcontractors and related subcontractor workers who enter into a construction or service contract with our university and perform subcontracting or service work within the university (such as food service companies, security companies, etc.).
Subcontractors and subcontractor workers involved in construction contracts for new buildings, maintenance of facilities, and interior construction within the university.

Contract Stage: Calculation of industrial safety and health management costs
Legal Basis: Industrial Safety and Health Act, Article 72 (Calculation of Industrial Safety and Health Management Costs for Construction Works, etc.)
(Calculation Criteria) When signing a construction contract for works exceeding 20 million KRW or when establishing a construction project plan.
The subcontractors must use the calculated industrial safety and health management costs for the prevention of workers' industrial accidents and health impairments, and keep the statement of use for one year after the construction work is completed.
 
Work Performance Stage: Operation of warning systems and training for hazardous work
Legal Basis: Industrial Safety and Health Act, Article 64, Paragraph 1, Item 5
Training for the operation of communication and warning systems, evacuation methods, etc., in preparation for incidents such as blasting operations, fires/explosions, collapses of earth and structures, or earthquakes.
 
Safety and Health Obligation Fulfillment Stage: Safety and health system inspection
Whether safety and health level assessments and selection procedures are followed at the time of subcontracting.
Review of the costs for safety and health management at the time of subcontracting.
Provision of information on hazardous materials and operations at the time of subcontracting.
Whether hazardous work is managed through a safety work permit system.
Review and confirmation of the appropriateness of safety and health activities such as risk assessments and safety and health education.

[Contract Guidelines for Overcoming COVID-19]
 
Temporary contract guidelines were implemented to mitigate the difficulties in civilian life caused by COVID-19.
 
(Emergency Bidding) Until 22.12.31, all competitive bidding can be issued as emergency bidding in principle, according to the Presidential Decree Article 35, Paragraph 4, Subparagraph 1 of 2, in cases necessary for the early execution of budget for national fiscal policy.
Applies to contracts announced for bidding until 22.12.31.
 
(Substitution of Bid Bond by Written Oath) Principally, a written oath can replace the bid bond for those who can be exempted from paying all or part of the bid security deposit.
However, for those who have concerns about contract fulfillment, such as companies that have been restricted from bidding in the past year due to failure to enter into a contract or non-performance, the written oath will not replace the bid bond.
 
(Prompt Payment of Advances and Subcontract Fees) The payment periods for advances and subcontract fees are shortened to ensure that the effects of fiscal execution appear quickly.
(Advances) Within 5 days from the request for advance payment, down from 14 days.
Applies to new requests for advance payment.
(Subcontract Fees) Within 5 days from the payment date, down from 15 days.
For subcontract fees that require the cooperation of the contract counterparty, incorporate into new contracts and encourage to shorten payment periods in existing contracts as well.
 
(Expansion of Advance Payment Limit) The limit for advance payments according to the government bidding and contract execution standard Article 34, Paragraph 1, is expanded from 70% to 80%.
Applies to advance payment requests until 22.12.31.
 
(Exemption from Delivery Responsibility) Companies unavoidably delaying or failing to perform contracts due to COVID-19 will be exempt from delivery responsibility.
